By using our services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please refrain from using our services.

1. Acceptance of Terms

By using our services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please refrain from using our services.

2. Use of our services

2.1. Age Requirement

You must be at least 13 years old to use our services. By using our services, you affirm that you are 13 years of age or above.

2.2. Discord Terms

Your use of our services that are accessed through Discord are also subject to the Discord Terms of Service at https://discord.com/terms and Discord Community Guidelines at https://discord.com/guidelines. Violation of these terms may result in the termination of your access to our services.

3. Restrictions

You may not reverse engineer, decompile, or disassemble our services. Any attempt to modify, reproduce, or distribute our services without authorization is strictly prohibited. If you believe you have found a security vulnerability in our services, please read our security policy for further direction.

4. User Conduct

4.1. Responsible Use

You agree to use our services responsibly and in compliance with applicable laws. Do not engage in any activity that disrupts the normal functioning of our services or violates the rights of others.

4.2. Prohibited Content

You may not use our services to distribute, upload, or transmit any content that is illegal, harmful, offensive, or violates the rights of others.

5. Privacy Policy

5.1. Data Collection

Buape Studios LLC will collect and process data related to your use of our services. We only store and process your personal data when you have voluntarily supplied us with it by interacting with our services. By using our services, you consent to the collection and processing of such data in accordance with this Privacy Policy.

5.2. Data We Collect

We collect and process the following information which may include your personal data.

  • We do store your Discord ID, Discord Username, Discord Server ID & Name, Discord Channel ID & Name, your user preferences, as well as all the data you supply to us and information provided by you when using our Discord bots.
  • If you are a premium user and you upload images to our servers, we store the image you uploaded to our servers for the purpose of displaying it within our services. This image is stored indefinitely for longterm use by yourself within our services until deleted from our servers by you or by us via the appropriate command.
  • We do not access or store phone numbers for our users.
  • We do not store messages from any users using Kiai. We do access message content sent by users, but these are only used in features such as our message content placeholder, and are not saved within our database.
  • We do collect anonymous analytics data to help us improve our services. This data may include information about your device, browser type, and usage patterns, but does not contain any personally identifiable information.

5.3. Data Retention:

All data relating to the a guild or user is kept for 30 days after a guild has been removed from our services, at which point it will be permanently and irreversibly deleted from our servers. If you wish to delete your data sooner, please contact us at legal@buape.com

5.4. Disclosure:

All data stored within our databases is confidential, and access is only granted to contractors of Buape Studios LLC on an as-needed basis. We do NOT sell your personal data and we don’t provide it to anyone outside our organisation for any other purpose than the Service you subscribed for.

6. Refund Policy

Buape Studios LLC does not offer refunds for any purchases related to our services except for extreme situations that have been preapproved by Buape Studios. All transactions are final. If you have concerns about a purchase, please contact us at support@buape.com to discuss the issue. Any attempts to issue a chargeback against us will result in a permanent and irreversible termination from our Services.

7. Additional Notes

Buape Studios reserves the right to terminate your access to our services at any time, for any reason, without prior notice. Termination may result from a violation of these Terms of Service or Discord's terms.

Buape Studios may update these Terms of Service at any time. Continued use of our services after such changes constitutes acceptance of the modified terms.

8. Disclaimer of Warranty

Our services are provided "as is" without any warranty. Buape Studios disclaims all warranties, express or implied, regarding our services's reliability and performance.

Buape Studios is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our services.
